Gemini, a cryptocurrency exchange, has filed a brief in its attempt to have a lawsuit launched against it by the US Securities and Exchange Commission dismissed. The lawsuit alleges that Gemini offered unregistered securities through its “Gemini Earn” service, which lets customers lend digital assets such as bitcoin to Genesis. In the latest filing, Gemini argued that the SEC has not made a clear claim against it and called for straightforward questions to be asked to determine if the service qualifies as a security. The court had not identified the security in question, while the SEC’s argument was described as “absurd on its face”.
